Welcome to Iron Excavator. These Terms of Service (“Terms”) govern your access to and use of the website located at https://ironexcavator.com (the “Site”) and the purchase of heavy machinery, mini excavators, attachments, and related products (“Products”) available through the Site.
By visiting our Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions, including those additional terms, conditions, and policies referenced herein and/or available by hyperlink.
1. General Conditions & E-Commerce
Our store is hosted via Hostinger and utilizes the WooCommerce e-commerce platform, which provides us with the online infrastructure to sell our Products to you. By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our Products for any illegal or unauthorized purpose.
2. Product Information & Commercial Use
Iron Excavator supplies heavy commercial machinery. We make every effort to display as accurately as possible the specifications, colors, and capabilities of our equipment. Because our units feature EPA-certified diesel engines designed for municipal and commercial job sites, it is the buyerβs responsibility to ensure that the operation of the equipment complies with all local, state, and federal regulations regarding heavy machinery use, licensing, and safety gear.
3. Pricing and Billing
Prices for our Products are subject to change without notice. We accept all major credit cards and PayPal. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per business, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing phone number provided at the time the order was made.
4. Shipping, Freight, and Risk of Loss
All mini excavators are shipped via third-party heavy commercial LTL freight from our Fort Collins, Colorado warehouse. We provide free shipping to the lower 48 states, including a lift-gate service.
- Delivery Timelines: Standard handling time is 1β3 business days. Transit times are estimated at 7β14 business days (14β21 days for AK & HI deliveries). These are estimates and not guaranteed delivery dates.
- Risk of Loss: Title and risk of loss pass to you upon delivery of the machinery to your designated address. It is your mandatory responsibility to inspect the equipment for transit damage before signing the driver’s Bill of Lading (BOL). By signing the BOL “free and clear,” you release Iron Excavator and the freight carrier from liability for subsequent damage claims.
5. Strict Return Policy
Due to the logistical costs and nature of heavy equipment, we strictly enforce our Return Policy. Once a machine or attachment has been operated, fueled, or used, it is entirely non-returnable. We accept returns only on unopened, unoperated machinery within 30 days of delivery. The buyer is responsible for all return LTL freight costs and potential restocking fees. 6. Warranties and Limitation of Liability
Our machinery is backed by a 3-Year Parts Warranty out of our warehouse, subject strictly to the condition that the buyer maintains and provides a valid Service and Maintenance Log. This warranty covers manufacturing defects in parts (e.g., engines, hydraulics) and explicitly excludes labor, consumables, wear items, and damage resulting from operator neglect or abuse.
Limitation of Liability: To the maximum extent permitted by law, in no case shall Iron Excavator, our directors, officers, employees, affiliates, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any Products procured using the Service.
7. Artificial Intelligence Communications
By contacting our support phone line (+1 (970) 528 3219), you acknowledge and consent that your call may be answered, recorded, transcribed, and processed by an Artificial Intelligence (AI) voice agent for the purposes of customer support, lead routing, and quality assurance.
8. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.
